Foreign air carriers may carry out international commercial flights involving commercial landing in the territory of the Republic of Poland, subject to permission granted by President of Civil Aviation Office of the Republic of Poland.

According to the article 193 item 1 of the Polish Aviation Act of 3rd July 2002 (Journal of Law of 2006 No. 100, item 696 as amended) a foreign air carrier may perform air carriage to/from the Republic of Poland only to the extent and on conditions set out in a permission issued by President of Civil Aviation Office of the Republic of Poland.

The following types of operation do not require permission from CAO Poland and are subject to clearance granted by the Polish Air Navigation Services Agency (PANSA) after a prior notification is sent directly to PANSA:

  • Private flights (non-revenue to the air carrier),
  • Overflights,
  • Technical landings,
  • Ferry positioning flights,
  • Commercial passenger flights operated with aircraft of 12 and less passenger seats,
  • Commercial cargo flights operated with aircraft of MTOW less that 5700 kg.
  • Commercial flights operated by air carriers holding a valid EU Operating Licence (air carriers of EU, Lichtenstein, Norway, Iceland) on routes within European Economic Area,
  • Commercial flights operated by Swiss air carriers on routes within European Economic Area, except cabotage flights within the territory of the Republic of Poland.

President of Civil Aviation Office of the Republic of Poland issues:

  • Single Permission for 1 to 9 commercial flights
  • General Permission for series of non-scheduled commercial flights comprising of at least 10 flights
  • Operating Permit for scheduled commercial flights

General Permission and Operating Permit are subject to the applicable aviation fee.

As the conditions to obtain a landing permission for air carriers from European Economic Area (EEA) and air carriers from countries not belonging to European Economic Area (NON-EEA) vary, the specific requirements related to landing permissions are defined below:
